"Site"- the website https://manqanebi.ge

"Owner"- the owner of the website https://manqanebi.ge, IE Aleksandre Zabakhidze

"User"- a natural or legal person who uses the services of the Site, posts a listing or searches for the desired products.

"Listing"- information  about real estate posted on the website.

1. Main terms of the agreement.

1.1 The Owner is not the organizer, co-participant, seller or buyer in any transaction. The Site is an intermediary that helps the seller and the buyer to contact each other.

1.2 The Owner ensures that listings are placed precisely in the relevant section, which helps the User to find real estate easily.

1.3"The Owner" does not own any of the products posted on the Site and does not possess any additional information about their actual condition.

1.4 The quality, safety, legality and conformity with the description of the real estate indicated in a listing are not controlled by the managing company.

1.5 The information posted on the Site serves the sale of the User's products and the establishment of contact with other users.

1.6 Any natural or legal person posts personal information on the Site of their own free will, based on their own interests.

1.7 When posting information on the Site, the User agrees that the information will be public and any user will be able to view it.

1.8 Pursuant to clause 1.7, the User assumes all risks associated with the dissemination of this information.

1.9 The information posted on the Site has no legal force; the User is obliged to verify the accuracy of the information before any financial transaction.

1.10 The User must read these terms and conditions. The Company is entitled, unilaterally, to make amendments and additions to the terms and conditions without prior notice to users. At the same time, the User's visit to/use of the website automatically means the User's consent to the requirements of these terms and conditions.

2. Posting listings

2.1 The User has no right to post on the Site a listing whose content contradicts the current legislation of Georgia.

2.2 To post a listing on the real estate site, you must register and agree to the terms of use of the manqanebi.ge site.

2.3 All natural and legal persons, except natural persons under 18 years of age, have the right to add listings on the Site.

2.4 The User is obliged, in accordance with the Site's instructions, to post complete information about the real estate for sale, photos depicting it and the terms of the agreement. In addition, the photos uploaded to the listing must relate only to the real estate offered for sale or its surroundings. It is prohibited to upload to a listing any visual other than a photo depicting the real estate offered for sale or its surroundings (in particular, the uploaded file must not be: a logo of an agency/construction company, a photo depicting other property, or contain the author's website, phone number, offered services or other extraneous information placed on the photo).

2.5 By posting a listing, the User confirms that they have the right to sell the real estate indicated in the listing, or have obtained the appropriate consent to offer the real estate for sale.

2.6 Adding a listing on the website 3 times within a month is free of charge; the fee and conditions for adding each subsequent listing are regulated according to the type of user.

2.7 The User may post a listing about real estate, including: apartments, private houses, country houses, commercial spaces, land plots and hotels.

2.8 A listing must not :

2.8.1 be false or inaccurate, and must not mislead the user.

2.8.2 serve fraud, deception or abuse of trust.

2.8.3 contain information about the purchase and sale of stolen or counterfeit products.

2.8.4 concern the tangible and intangible property of a third party, and must not violate the personal rights of a third party.

2.8.5 contain information that damages the dignity or business reputation of a third party.

2.8.6 contain discrimination against religious, ethnic or other minorities.

2.8.7 contain threats against anyone.

2.8.8 call for criminal acts.

2.8.9 support or provoke terrorist and extremist acts.

2.8.10 contain pornographic content.

2.8.11 contain advertising information about property, items or services other than the subject of the listing, or about a company (in particular, it is prohibited to indicate phone numbers with paid telephone information services in a listing or in a user/agency profile).

2.8.12 violate the current legislation of Georgia in any other way.

2.9 The User cannot draw a conclusion about the legality of a transaction from the fact that the product is posted on the Site.

2.10 If a user profile and/or listing on the Site is blocked or other restrictive measures are taken, the paid service on the listing is cancelled and the amount paid for its purchase is not refunded to the User. Paid services are also not transferred from one listing to another.

2.11 If the desired goal is achieved as a result of adding a listing on the Site, as well as in the event of deletion of the listing and/or cancellation of the user profile, the amount paid for the purchased paid service is not refunded to the User, and unused paid services are not transferred to another listing.

3. Rights and obligations of the Owner

3.1 The Owner is not a party to any agreement and is not responsible for the actions of any user. All negotiations take place directly between users.

3.2 The Owner is not liable for the accuracy of the information posted on the Site.

3.4 The Owner cannot guarantee that the data of the person posting a listing, as given on the Site, will match their actual data.

3.5 Any listing posted on the Site in violation of clause 2.7 will be deleted, and the username under which such a listing was posted will be blocked, depending on the content of the listing, for a period ranging from 1 week to a permanent ban.

3.6 In the event of two or more violations of clause 2.7, the managing company has the right to block the User's phone number and IP address.

3.7 The Owner has the right to advertise a published listing in a manner different from the type indicated by the User.

3.8 The Owner has the right to stop the publication of any listing at any time.

3.9 The Owner is not liable for the loss of or damage to information posted on the Site, nor for the loss of messages.

3.10 The Owner does not guarantee the continuous and uninterrupted operation of the Site.

3.11 If several users are registered for the purpose of posting a large number of listings on the Site, the Owner has the right to block the User's IP address.

3.12 In the event of a breach of the agreement, the managing company has the right to block the User's IP address.

3.14 The Owner may change this agreement without any special notice. Changes to the agreement will be reflected in the ‘Site terms of use’ section.

3.15 The Owner has the right to send the User promotional messages , special offers and promotions to the number provided by the User on the Site.

4. Rights and obligations of the User

4.1 The User has no right to transfer their username and password to a third party

4.2 If there is any suspicion that personal data has been disclosed, the User is obliged to change it immediately.

4.3 The User is prohibited from posting on the Site listings other than those specified in clause 2.7.

4.4 The User is obliged to immediately notify the managing company, using the "Report an incorrect listing" button, about listings that in any way violate the rules of the website or contradict the current legislation of Georgia.

4.5 The User is prohibited from placing any kind of advertising in a listing (other than the subject of the listing) or including a link to another site.

4.6 The User is obliged to act in accordance with the current legislation of Georgia and the rules of the Site, and is liable under the legislation of Georgia for the actions carried out by them on the Site.

4.7 If the User has any claim or misunderstanding with another user, they shall submit their claims directly to the user against whom they have the claim, independently of the managing company. The User releases the managing company (as well as any of its employees) from all claims, including: compensation for damage, reimbursement of costs and reimbursement of any expenses related to an agreement concluded through the Site.

4.8 The User may use the Site without any warranty and in accordance with the current legislation of Georgia.

4.9 The User assumes full responsibility for the information posted on the Site; the Site provides them with the means to supply information to other users.
4.10 The User declares and confirms that the products/services presented by them are in full compliance with the "Product Safety and Free Movement Code", the Law of Georgia "On Advertising" and other legislative norms in force in this field.
4.11 The User also declares and confirms that the information and advertising material provided for the products/services to be posted by them, and/or the creation thereof, will not infringe the copyright of third parties.
4.12 Based on the above, the User confirms that, upon request, they will immediately cancel the relevant listing and/or will have no claim regarding the cancellation of such a listing by the Site, if a discrepancy is found between the guarantees declared by the User and the listings registered on the Site's  online portal.
4.13 The User also agrees to fully compensate the damage caused to the "Site" and the fines imposed on it as a result of any inconsistency of these statements.
4.14 The User is entitled to apply to the Company in writing and request the return/cash-out of the positive remainder on their personal balance. The refund will be made within 30 (thirty) calendar days of such a request, provided that the Owner  is entitled to withhold 10% (ten percent) of the amount to be refunded as a penalty. 
4.15 The User must take into account that if funds credited/deposited to the personal balance have not been used within the last 24 (twenty-four) months since they were credited/deposited, the Owner  is entitled to reset the remainder on the User's personal balance to zero, and the deducted amount will be deemed a penalty.

4.16  By agreeing to this agreement,  the User confirms that the Owner has the right to notify you of promotional offers and promotions, or to send you promotional messages, at the number you provided.

5.Registration rules:

5.1 The User is obliged to provide real data, a contact number, e-mail address, gender, location and year of birth.

5.2 It is prohibited to provide another person's data during registration.

5.3 The username and password must be an active e-mail address owned by the User; it may contain Latin characters (A-Z), digits (0-9) and symbols.

5.4 It is prohibited to include any offensive phrase in the username.

5.5 If the funds deposited by the User are not used within 2 years of the User's last deposit, the balance is reset to zero.

Condition of using the Site:
By entering the Site, the User confirms and agrees that its content, the listings, photos and other information posted by users constitute the property of the Site. Unauthorized use and/or duplication in any form of this material, or its transfer to a space owned by a third party, constitutes use of the Site's commercial "assets", which is strictly prohibited without the public consent of this Site and/or the written permission of IE "Marine Moseshvili". 

Basis:

• The website manqanebi.ge is the property of IE Marine Moseshvili (identification code: 60001127236). The "Owner" has the exclusive right to use the content posted on the Site, including but not limited to photographic material and any kind of information posted by users, which, under the current legislation, also grants it  the exclusive authority to prohibit any unauthorized use and dissemination, in any form, of the materials posted on the Site;
• The Owner  reserves the right, in the event of unauthorized use/exploitation of the content posted on the Site, including but not limited to photographic material and any kind of information posted by users, to claim compensation for damage in accordance with the "Website terms of use";

Infringement of the rights of the holder of copyright and related rights and of the database maker constitutes a punishable act and entails criminal liability (see Article 189 of the Criminal Code of Georgia)
